Agreement between User and myWealthBeing

Effective Date: January 1, 2025

Welcome to myWealthBeing (“myW,” “we,” “our,” or “us”). These Terms & Conditions (“Terms”) govern your access to and use of the myWealthBeing website (www.myWealthBeing.org, the “Site”) and the myWealthBeing WebApp (the “App” or “Service”). By using the Site or App, you agree to be bound by these Terms.

If you do not agree, you must not access or use our Site or App.


1. Eligibility & Age Restrictions

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App, including its free and paid modules.
  • The Site is available to users 13 and older. Users between 13–17 may use the Site only with parental or guardian consent.
  • We do not knowingly collect personal information from children under 13.

2. Account Registration & Security

  • Certain features of the App require you to create an account.
  • You agree to provide accurate, current, and complete information.
  • You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

3. License to Use Website & WebApp

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site and App strictly in accordance with these Terms.

  • You may not copy, modify, reverse engineer, distribute, sell, or create derivative works of the Site or App.
  • All rights not expressly granted are reserved to myWealthBeing and its licensors.

4. User Responsibilities & Conduct

You agree not to:

  • Use the Site or App for unlawful or prohibited purposes.
  • Upload false, misleading, or harmful information.
  • Introduce malicious code, disrupt the Service, or attempt unauthorized access.

5. Financial Information Disclaimer

  • The App may provide budgeting, projections, calculators, or other financial tools.
  • These are educational only and do not constitute financial, tax, investment, or legal advice.
  • Always consult qualified professionals before making financial decisions.
  • We are not liable for any loss or damage arising from reliance on the information provided.

6. Payments, Subscriptions & Refunds

  1. Fees and Billing
    • Certain App modules (“Premium Services”) require a paid subscription.
    • Payments are processed through third-party providers; we do not store payment card details.
  2. Auto-Renewal
    • Subscriptions automatically renew at the end of each billing cycle (monthly or annually, as selected).
    • By subscribing, you authorize recurring charges to your payment method.
  3. Cancellations
    • You may cancel at any time via your account settings.
    • Cancellations take effect at the end of the billing cycle.
  4. Refunds
    • myWealthBeing is a nonprofit, and fees support our educational mission.
    • Initial Purchases: 7-day refund window for first-time subscription purchases (email info@mywealthbeing.org).
    • Renewals: Non-refundable. Cancel anytime to avoid future charges.
    • Exceptions: At our discretion, we may issue refunds for billing errors, duplicate charges, or extenuating circumstances.
  5. Changes to Fees
    • We may modify subscription fees with prior notice. Changes apply to future billing cycles.

7. Privacy & Data Security

  • Your use of the Site and App is subject to our Privacy Policy, available at mywealthbeing.org/privacy.
  • Data you provide (e.g., balances, assets, business information) is stored on Knack.com servers, a third-party service provider.
  • We use commercially reasonable safeguards but cannot guarantee absolute security.
  • By using the App, you consent to the storage and processing of your data by Knack and other vendors we use.

8. Intellectual Property

  • All content, graphics, tools, and trademarks on the Site and App belong to myWealthBeing or its licensors.
  • You may not reproduce, redistribute, or exploit any part of our intellectual property without written permission.

9. Third-Party Services & Links

  • The Site and App may contain links to third-party websites or services.
  • We are not responsible for their content, accuracy, or practices.
  • Use of third-party services is at your own risk.

10. International Users

  • The Services are controlled and operated from the United States.
  • Users outside the U.S. are responsible for compliance with local laws.
  • You may not use the Services in violation of U.S. export laws or applicable local restrictions.

11. Termination of Access

We may suspend or terminate your account or access at our sole discretion, with or without notice, for violation of these Terms or other harmful conduct.


12. Disclaimer of Warranties

The Site and App are provided “as is” and “as available.”

  • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
  • We do not guarantee that the Service will be uninterrupted, error-free, or secure.

13. Limitation of Liability

  • To the fullest extent permitted by law, myWealthBeing and its affiliates shall not be liable for indirect, incidental, special, or consequential damages.
  • Our total liability for any claim shall not exceed the fees you paid us in the 12 months prior to the claim (if any).
  • Some jurisdictions do not allow certain exclusions; in such cases, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless myWealthBeing, its directors, officers, employees, agents, and partners from any claims, damages, or expenses arising out of:

  • Your use of the Site or App,
  • Your violation of these Terms, or
  • Your infringement of third-party rights.

15. Arbitration & Class Action Waiver

  • Any dispute shall be resolved by binding arbitration under the Federal Arbitration Act and administered by the American Arbitration Association.
  • Arbitration will take place in Colorado, unless otherwise agreed.
  • Class actions are not permitted. Claims may be brought only in an individual capacity.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of Colorado, USA. Users consent to arbitration in Colorado and, where applicable, the jurisdiction of Colorado courts.


17. Severability & Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision does not constitute a waiver of rights.


18. Changes to Terms

We may revise these Terms from time to time. Updates will be posted at https://www.mywealthbeing.org/terms-and-conditions. Continued use after changes constitutes acceptance.
